The Supreme Court in India is considering legalizing same-sex marriage. However, they will not be discussing personal laws related to marriage. Instead, they will focus on the Special Marriage Act, which allows people of different religions or castes to marry. The court also stated that the definition of a man and a woman under this act is not solely based on genitals. Some lawyers expressed concern about the impact of legalizing same-sex marriage on personal laws related to marriage for different religious groups. The court suggested that they only address arguments related to the Special Marriage Act, which is religion-neutral. The Solicitor General argued that while individuals have the right to privacy, choose partners, and choose their sexual orientation, the socio-legal status of marriage cannot be granted through judicial decisions or legislation. Finally, the Solicitor General expressed concern about how legalizing same-sex marriage could affect Hindus, Muslims, and other communities.
