The Supreme Court has issued an important decision about the disqualification of Telangana MLAs who switched from the BRS party. The Court instructed the Telangana Assembly Speaker to decide on this issue within three months and accepted the petition from the defected MLAs. However, Chief Justice BR Gavai rejected the BRS’s request to expel these MLAs from the Assembly.
The Supreme Court also reversed a previous judgment by the High Court Division Bench. Chief Justice Gavai urged Parliament to set a deadline for the Speaker to resolve such matters.
This case has generated much legal discussion on whether courts can influence the Speaker’s power to rule on disqualification. After thorough debates, Justice Gavai’s bench made its final decision on April 3 this year.
The ruling is viewed as a key moment in the ongoing political and legal conflict over MLA defections in Telangana.
