Andhra Pradesh CID is considering challenging the High Court’s decision to grant regular bail to former Chief Minister N Chandrababu Naidu. The State Government believes that the High Court’s order went beyond the limits of bail parameters set by the Supreme Court. They argue that the court made observations and judgments on aspects that were not argued by the petitioners and were not within the court’s scope of consideration.
The High Court’s order seemed to exceed its jurisdiction by commenting on the material, its relevance, its credibility as evidence, and the gaps in the ongoing investigation. The TDP officials involved in the case obstructed the investigation by not providing the requested information.
The State Government finds it concerning that the High Court took on the role of a trial court by pronouncing a verdict on the merits of the case while claiming not to consider the merits. The CID argues that the High Court’s decision to grant bail overstepped its jurisdiction at this stage.
During the bail petition arguments, the petitioners did not present their case, and the CID raised objections, which were duly recorded by the court.
The High Court’s approach to a bail petition was unprecedented and resembled a full trial on the allegations in an ongoing investigation.
